Terms & Conditions Effective Date: 26th May 2025

In the following conditions of contract, “Vin Virdi” shall mean Johara Consultancy LTD, trading as Vin Virdi, or any makeup artist(s) appointed by or working on behalf of Johara Consultancy LTD.
“The Client(s)” shall mean the person(s) whose name(s) appear on the booking confirmation or who are responsible for the payment of the services.

Where the Client(s) arrange for a third party to meet the costs of this contract, the contractual relationship remains with the Client(s), who retain full responsibility for compliance with these Terms.

The due performance of this contract is subject to the conditions set out herein. These Terms and Conditions may not be varied in any way by the Client(s) unless expressly agreed in writing by Johara Consultancy LTD.

These Terms and Conditions may be updated at any time without prior notice and replace all previously issued versions. The most current version will always be available at vinvirdi.com.

 

  1. Scope of Services
    1. All services are performed with reasonable care and skill, as required under the Consumer Rights Act 2015. Services will be delivered as outlined in the booking confirmation. The Artist may use qualified assistants or subcontractors as necessary.
  2. Booking & Deposit
    1. A non-refundable deposit of 50% is required to secure all bookings.
    2. A booking is not confirmed until the deposit has been received and written confirmation is issued.
    3. The deposit is deducted from the final balance.
    4. By paying the deposit, the Client agrees to these Terms.
  3. Trials
    1. Trials are strongly recommended but not mandatory.
    2. Trial fees are charged separately and are non-refundable.
    3. Patch testing is available on request.
    4. The Artist accepts no responsibility for dissatisfaction or reactions if the Client declines a trial or patch test.
  4. Final Balance & Payment
    1. The remaining balance is due no later than 14 days before the Event.
    2. Accepted payment methods: bank transfer (preferred) or pre-approved cash.
    3. If payment is not made by the deadline, the Artist may cancel the booking and retain the deposit.
    4. For bookings made less than 14 days before the Event, full payment is required immediately.
    5. In certain cases (at the Artist’s discretion), the balance may be paid on the Event day, but must be received before the Artist departs.
  5. Non-Payment & Debt Recovery
    1. Failure to pay the balance in full on the Event day constitutes a breach of contract.
    2. In such cases, the Client will be liable for:
      1. A late fee of £50 per day, and
      2. All reasonable debt recovery and legal costs
    3. The Artist reserves the right to pursue recovery through a debt collection agency or issue a legal claim via the County Court Money Claims Centre (CCMCC).
    4. Legal action may proceed without further notice, and interest may accrue under the Late Payment of Commercial Debts (Interest) Act 1998.
  6. Amendments & Reductions
    1. Any changes to the booking — including date, start time, location, services, or party size — must be made in writing and are subject to availability.
    2. Changes to start time or event location must be confirmed at least 48 hours in advance.
    3. Last-minute changes (less than 48 hours’ notice) may not be accommodated and do not entitle the Client to a refund if services cannot be delivered as a result.
    4. Reductions in party size made less than 14 days before the Event will not reduce the total fee payable.
  7. Client Cancellation
    1. Cancellations must be made in writing (email).
    2. Bridal bookings: Cancellations within 30 days = deposit forfeited
    3. Party bookings: Cancellations within 14 days = deposit forfeited
    4. Deposits may be transferred once to a new date within 12 months, subject to availability.
    5. No refund will be issued for same-day cancellations or no-shows.
    6. Refunds (if applicable) will be processed within 14 business days.
  8. Artist Cancellation
    1. If the Artist is unable to attend due to emergency or illness, all efforts will be made to find a suitable replacement.
    2. If no substitute is available, a full refund of all monies paid (including deposit) will be issued.
    3. The Artist’s liability is strictly limited to the amount paid.
  9. Force Majeure
    1. Neither party shall be liable for cancellations due to events beyond their control (e.g., fire, flood, pandemic, severe illness).
    2. In such cases, services may be rescheduled or refunded proportionately.
  10. Travel & Accommodation
    1. Travel beyond 5 miles of Ilford is charged at £0.50 per mile (round trip).
    2. Parking charges, tolls, congestion fees, and additional travel expenses are payable by the Client.
    3. Start times before 4:00 AM will incur an early start fee or overnight accommodation, to be agreed in advance.
  11. Punctuality & Lateness
    1. The Client and party must be ready at the agreed time.
    2. A £50 per hour (or part thereof) waiting fee will be charged for delays caused by the Client.
    3. If delays prevent full delivery of services, the full agreed fee remains payable.
  12. Environment & Working Conditions
    1. The workspace must be clean, safe, and well-lit (natural light preferred).
    2. A table, chair, and power outlet must be made available.
    3. Inadequate or unsafe working conditions may result in reduced service or cancellation without refund.
  13. Children & Safety
    1. The Client must ensure children are kept away from the Artist’s makeup, tools, and equipment at all times.
    2. Heated equipment and cosmetics can pose injury risks.
    3. The Artist is not liable for injuries or damages caused by children.
    4. Repeated safety risks or distractions may result in services being paused or cancelled without refund.
  14. Allergies, Health & Hygiene
    1. The Client must disclose all relevant health conditions, allergies, or sensitivities before the Event.
    2. Patch tests are available upon request.
    3. Clients who decline a patch test assume all related risks.
    4. The Artist may refuse service for health and safety reasons (e.g., infectious conditions).
    5. The Artist follows strict hygiene protocols and uses sanitized tools and disposables.
  15. Liability & Insurance
    1. The Artist holds public liability insurance.
    2. Liability is limited to the total amount paid for the booking.
    3. The Artist is not liable for indirect loss, dissatisfaction due to Client choices, or undisclosed allergies.
    4. Nothing in these terms excludes liability for personal injury or death due to negligence.
  16. Photography & Social Media
    1. The Artist may take and use photographs or videos of completed looks for their portfolio, website, and social platforms.
    2. No identifiable images will be posted before the Event without consent.
    3. Clients may opt out of media use by providing written notice in advance.
    4. Images shared by photographers may be reposted by the Artist with credit and consent.
  17. Data Protection
    1. Johara Consultancy LTD complies with the UK GDPR and Data Protection Act 2018.
    2. Client data is used solely for communication, scheduling, and legal compliance.
    3. Clients may request data access, updates, or deletion at any time.
  18. Conduct & Behaviour
    1. Mutual respect is required.
    2. The Artist reserves the right to end the session immediately without refund if subjected to abuse, harassment, or unsafe behaviour.
  19. Third-Party Payments
    1. If payment is made by someone other than the Client, the Client remains fully responsible for the booking and all outstanding amounts.
  20. Intellectual Property
    1. All look designs, face charts, and content created by the Artist remain the intellectual property of Johara Consultancy LTD.
    2. These materials may not be reused commercially without written permission.
  21. Dispute Resolution
    1. Disputes should be raised in writing.
    2. If unresolved, disputes will be handled under the exclusive jurisdiction of the courts of England and Wales.
  22. Governing Law
    1. These Terms & Conditions are governed by the laws of England and Wales.
  23. Entire Agreement
    1. This agreement constitutes the full understanding between the Artist and the Client.
    2. No oral or informal communication shall override these Terms unless agreed in writing.
  24. Client Confirmation & Acceptance
    1. By paying a deposit or confirming a booking, the Client agrees to these Terms and Conditions in full.
